PAYMENTS TO DATE

Substantial payments were made to eligible investors in the first phase of fund distribution. Payments on qualifying claims submitted by the deadline of December 15, 2006 in the second phase of the Settlement were issued beginning in May 2007. On September 12, 2007 the Court ordered the payment of all valid, late-filed claims received as of September 12, 2007, and these payments were issued on September 27, 2007.
