RECENT SETTLEMENT EVENTS

By Order dated September 22, 2006, the Court directed the Distribution Fund Administrator to pay all validated, late-filed claims and to engage in additional outreach to locate eligible recipients under the Plan who have yet to submit a claim in the Bear Stearns, Citigroup, CSFB, J.P. Morgan, Lehman Brothers, Merrill Lynch, Morgan Stanley, US Bancorp Piper Jaffray, Thomas Weisel, and UBS Securities funds. (Deutsche Bank Securities Inc. and Goldman, Sachs & Co. funds have been depleted by paying valid claims.) All investors that could be identified by the records of the Settling Parties as potential fund recipients were mailed another Notice in early October 2006, informing them of the steps they need to take to be eligible for a payment. The postmark deadline for returning completed forms to the Distribution Fund Administrator in this second phase of the Settlement was December 15, 2006. Payment of valid, timely claims submitted during the additional outreach period began on May 8, 2007. On September 12, 2007 the Court ordered the payment of all valid, late-filed claims received as of September 12, 2007, and these payments were issued on September 27, 2007.
